other تحلیل حقوقی، کاستی‌ها و چالش‌های قانونی مدیریت سلامت شهری در ایران (تحلیل تطبیقی با کشورهای پیشرو) تخصصي Special كاربردي Applicable <span style="font-size:12pt"><span style="text-justify:kashida"><span style="text-kashida:0%"><span style="line-height:normal"><span style="direction:rtl"><span style="unicode-bidi:embed"><span style="font-family:Calibri,sans-serif"><span lang="FA" style="font-size:11.0pt"><span b="" mitra="" style="font-family:"><span style="color:#0d0d0d">با عنایت به گسترش روزافزون شهرنشینی و آثار مترتب بر آن در حوزه سلامت محیطی و کیفیت زیست شهری، بررسی نظام حقوقی حاکم بر مدیریت سلامت شهری از اهمیت مضاعفی برخوردار است. این پژوهش با رویکردی توصیفی-تحلیلی، به واکاوی و ارزیابی مبانی حقوقی، ساختارهای نهادی، نظام‌های تقنینی و رویه‌های اجرایی مرتبط با حقوق و قوانین مدیریت سلامت شهری در ایران می‌پردازد. یافته‌ها نشان می‌دهند، علی‌رغم وجود پاره‌ای از اصول و قواعد کلی در قانون اساسی و قوانین موضوعه نظیر قانون شهرداری‌ها و قانون حفاظت از محیط زیست، نظام حقوقی مدیریت سلامت شهری در ایران با چالش‌هایی جدی مواجه است. این چالش‌ها عبارتند از: عدم انسجام و یکپارچگی قوانین و مقررات، فقدان ضمانت‌های اجرایی قوی و کارآمد، ابهام در حدود صلاحیت و مسئولیت نهادهای ذی‌ربط، و محدودیت منابع مالی اختصاص‌یافته. </span></span></span><span lang="AR-SA" style="font-size:11.0pt"><span b="" mitra="" style="font-family:"><span style="color:#0d0d0d">یافته‌های این مقایسه نشان می‌دهد که با وجود چالش‌ها و کاستی‌های عمیق این حوزه، به‌کارگیری مقررات و قوانین پیشنهادی و نیز الگوهای موفق جهانی به ویژه در زمینه تقویت نظارت، انسجام قوانین و ارتقاء آموزش عمومی، می‌تواند نقش مهمی در بهبود وضعیت سلامت شهری در ایران ایفا کند. بر این اساس، پیشنهاد می‌شود تدوین سیاست‌های یکپارچه و ارتقاء ظرفیت‌های نهادی با هدف ایجاد شهرهای سالم و پایدار در دستور کار سیاستگذاران و مدیران شهری ایران قرار گیرد. همچنین کاربست و</span></span></span><span lang="FA" style="font-size:11.0pt"><span b="" mitra="" style="font-family:"><span style="color:#0d0d0d"> تصویب قانون جامع مدیریت سلامت شهری، تقویت سازوکارهای نظارتی و اجرایی، شفاف‌سازی نقش و وظایف دستگاه‌های مسئول، و ایجاد منابع مالی پایدار و مکفی در جهت ارتقاء سلامت محیطی و بهبود کیفیت زندگی شهروندان در دستور کار نهادهای تقنینی و اجرایی کشور قرار گیرد.</span></span></span><span dir="LTR" style="font-size:11.0pt"><span style="color:#0d0d0d"></span></span></span></span></span></span></span></span></span><br> &nbsp; <span style="font-size:12pt"><span style="text-justify:kashida"><span style="text-kashida:0%"><span style="line-height:normal"><span style="font-family:Calibri,sans-serif"><span lang="EN" style="font-size:9.0pt"><span new="" roman="" style="font-family:" times=""><span style="color:#0d0d0d">Recognizing the ever-increasing expansion of urbanization and its resulting effects on environmental health and urban quality of life, an examination of the legal system governing urban health management is of paramount importance. This research, employing a descriptive-analytical approach, delves into and evaluates the legal foundations, institutional structures, legislative systems, and executive procedures related to the rights and laws governing urban health management in Iran. The findings reveal that, despite the existence of certain general principles and rules in the Constitution and subject laws such as the Municipality Law and the Environmental Protection Law, the legal system of urban health management in Iran faces serious challenges. These challenges include: a lack of coherence and integration of laws and regulations, a lack of strong and effective enforcement guarantees, ambiguity regarding the scope of competence and responsibility of relevant institutions, and limitations in allocated financial resources. The findings of this comparison indicate that, despite the deep challenges and shortcomings in this area, the application of proposed regulations and laws, as well as successful global models, especially in the areas of strengthening oversight, integrating laws, and promoting public education, can play an important role in improving the state of urban health in Iran. Accordingly, it is proposed that the formulation of integrated policies and the enhancement of institutional capacities with the aim of creating healthy and sustainable cities be placed on the agenda of policymakers and urban managers in Iran.
