fa تحلیل محتوای قوانین و ضوابط معماری و شهرسازی مرتبط با افراد کم‌توان و توانیاب تخصصي Special پژوهشي Research <p dir="RTL">حضور همه انسان چه توانمند و چه توانیاب در محیط و انجام فعالیت&shy;های حیاتی، مستلزم مناسب بودن محیط شهری و دارابودن استقلال حرکتی است. به همین دلیل در راستای برقراری عدالت اجتماعی و حقوق شهروندی، نهادهای ذی‌ربط در سا&shy;&shy;ل&shy;های اخیر کوشیده‌اند، ضوابط و قوانینی در این راستا، مصوب کنند. اجرای اصولیِ مناسب‌سازی‌ فضاهای شهری در جهت تسهیل حرکت افراد دارای معلولیت، نیازمند ضوابط استاندارد است. در همین راستا، هدف این پژوهش، بررسی و تحلیل قوانین موجود در ارتباط با افراد دارای معلولیت می‌باشد. پس از بررسی قوانین، ضوابط و مصوبات، با استفاده از تحلیل محتوا قوانین و مصوبات، موضوعات اصلی استخراج و در ادامه میزان فراوانی آن&shy;ها در قوانین داخلی بیان شده است. نتایج به‌دست‌آمده نشان می&shy;دهد، دو موضوع &quot;رعایت ضوابط&quot; و &quot;دستورالعمل مناسب‌سازی&quot; بیشترین حضور را در مجموعه قوانین داشته و دو نهاد مرکز مطالعات راه و مسکن و شهرسازی وزارت راه و شهرسازی و همچنین معاونت شهرسازی و معماری شهرداری تهران و اداره کل معماری و ساختمان، ضوابط و دستورالعمل&shy;هایی را در ارتباط با بهینه‌سازی حضور معلولان تصویب کردند. بررسی ضوابط و دستور العمل ها نشان می‌دهد مهم‌ترین چالش و خلا در مسیر اجرای این ضوابط، عدم جامعیت قوانین و ضوابط، نبود ضمانت اجرایی مناسب و یک برنامه جامع و همچنین عدم پیش بینی منابع جهت تامین نیازهای مالی در راستای اجرای ضوابط و قوانین است که همچنان وضعیت حضور معلولین و افراد توانیاب در شهر با مشکل مواجه است.</p> <p dir="RTL"></p> <p dir="RTL"></p> <p>The presence of human beings in the environment and performing vital activities requires being suitable for the urban environment and having the minimum ability in terms of motor independence. For this reason, to establish social justice and citizenship rights, the relevant institutions have tried in recent years to adopt related rules and regulations. Implementing the principles of adaptation to facilitate the movement of people with disabilities requires standard criteria. In this regard, the purpose of this study is to review and analyze the existing laws related to people with disabilities. After reviewing the rules, regulations, and approvals, using the content analysis of the laws and ratification, the main issues are extracted, and their frequency is beginning in the domestic laws. The obtained results show that the two matters of &quot;compliance with the rules&quot; and &quot;adaptation instructions&quot; have had the most presence in the set of laws, as well as the two institutions of the Center for Road and Housing and Urban Studies of the Ministry of Roads and Urban Development and the Deputy of Urban Planning and Architecture of Tehran Municipality and The entire architecture and building body adopted rules and regulations regarding the optimization of the presence of the disabled. surveying of rules and regulations shows that the most important challenges and gaps in the implementation of these rules are the lack of comprehensiveness of rules and regulations, lack of proper enforcement guarantees and a comprehensive plan, as well as lack of financial resources to implement the rules and regulations.
