fa بررسی محدودیتهای حقوق مالکانه در قانون شهرداری‌ها <p dir="RTL">حقوق مالکانه از ادوار گذشته، یکی از مهم‌‌ترین مسائل مورد چالش بین اشخاص و دولت‌ها به مفهوم عام کلمه بوده است. در اعصار مختلف به طرق گوناگون، مالکیت خصوصی اشخاص با دخالت دولت ها تحدید و در مواردی سلب شده است به طوری که این مداخلات، در زندگی خصوصی اشخاص به عنوان یکی از مخاطرات غیر قابل انکار به شمار می‌ رود. این پژوهش با بررسی مفهوم حقوق مالکانه در شرع و قانون و جایگاه آن در برابر منافع عمومی، به معرفی عوامل محدودکننده مالکیت خصوصی در قانون شهرداری ها پرداخته است و با اشاره به مصادیق محدودیت‌های موجود، ضمانت‌ های احکام صادره و قواعد آمره در قانون شهرداری ها را مورد واکاوی قرار داده است. مطالعه منابع و ماخذ حقوقی، ناکارآمدی و قدیمی بودن قوانین مدیریت شهری را نشان می دهد که روزآمدی این قوانین موجبات ساماندهی بخشی از مشکلات این حوزه را فراهم می نماید. همچنین آموزش و آشنا نمودن شهروندان با فرهنگ شهرنشینی و مقررات این حوزه می تواند دولت ها را در اعمال مدیریت و اجرای قوانین یاری نماید. پذیرش این معنا که تحدید حقوق مالکانه، برای تأمین ایمنی، سلامتی و آسایش زندگی شهری و برخورداری یکسان آحاد جامعه از تسهیلات و تجهیزات و خدمات عمومی شهری اجتناب ناپذیر است زمینه های نیل به شهری مطلوب را میسر می سازد. نتایج این پژوهش می تواند به طور کاربردی برای برنامه ریزان حوزه مدیریت شهری&nbsp; به کار گرفته شود.</p> <p>Equity law has been one of the most important issues of challenge between individuals and governments in the general sense of the word. In different times, private ownership of individuals has been deprived by government&#39;s intervention and in cases such interference is considered as one of the undeniable hazards in private life. This study examines the concept of equity law in law and law and its place against public interest in the introduction of restrictions of private property in the municipality&#39;s law, and by referring to the examples of restrictions, rules of verdicts and the binding principles of liability has been investigated in the municipality&#39;s law. The study of the legal sources and sources shows the inefficiency and of urban management rules that regulate these rules to regulate part of the problems in this area. Also training and acquainting the citizens with the culture of urbanization and regulations of this field can help governments to apply and enforce laws.
