fa بررسی ابعاد مرور زمان در دعاوی مربوط به حمل و نقل زمینی (شهری و بین شهری) تخصصي Special پژوهشي Research <p dir="RTL">در غالب کنوانسیون های بین المللی حمل و نقل و مقررات داخلی کشورها، به منظور حمایت از طرفین،&nbsp; مرور زمان کوتاه برای دعاوی ناشی از حمل و نقل مقرر شده است، به نحوی که حصول مرور زمان به عنوان یکی از علل معافیت از مسئولیت متصدی حمل تلقی می شود. موضوع این نوشتار، بررسی ابعاد مختلف مرور زمان در مقررات حمل و نقل زمینی (ریلی و جاده ای شهری و بین شهری) ایران و برخی از کنوانسیون های مهم بین المللی حمل و نقل ریلی و جاده ای کالا و مسافر، یعنی سی ام آر، سی وی آر، سی آی ام و سی ای وی می باشد. ابعادی نظیر قلمرو، مدت، نقطه شروع، تعلیق، انقطاع مرور زمان مورد توجه این نوشتار می باشد. نتایج بررسی ها نشان می دهد بین کنوانسیون های مورد بحث در خصوص مقررات مرور زمان تشابهات زیادی وجود دارد، و همچنین بین کنوانسیون های مذکور و&nbsp; حقوق ایران، علی رغم وجود برخی تفاوتها، به عنوان مثال مرور زمان صدمات بدنی ناشی از حمل مسافر، در مجموع می توان گفت، بین حقوق ایران و کنوانسیون های مذکور در مقررات مرور زمان حمل و نقل کالا (نه مسافر) وجوه اشتراک مناسبی وجود دارد.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</p> <p>In most of international carriage conventions and national regulations, in order to protect the parties, especially carrier, short period of time for actions arising out of carriage is determined, so that the attainment of lapse of time is considered as one of the causes of exemption from the liability of carrier. The issue of this writing is investigation of different dimensions of lapse of time in land carriage regulations (rail and road) of Iran and a number of the important international conventions on transport of goods and passenger by road and rail, namely; CMR, CVR, CIM and CIV. Dimensions such as scope, period of time, starting point, suspention, interruptions of lapse of time are regarded in this writing. The results of investigations show that great similarities exist among the discussed conventions, concerning the regulations of lapse of time.
